Biometric Privacy Policy
Purpose
TempWorks Software, Inc., ARA, Inc., and TempWorks Management Services Inc. (collectively, or in reference to any one of them, “TempWorks”) have developed and instituted the following policy related to any biometric data that TempWorks possesses as a result of (i) TempWorks’ operations, or (ii) TempWorks’ customers’ and customers’ employees’ or contractors’ usage of TempWorks’ services. As used in this policy, “biometric data” means any biological characteristics of a person, or information based upon those characteristics, including characteristics defined as “biometric identifiers” and “biometric information” in the Illinois Biometric Privacy Act.
TempWorks may collect, use, and/or transmit biometric data during the course of its operations, and of providing services to its customers (and their customers, employees, and contractors). With respect to biometric data collected, used and/or transmitted by TempWorks, to the extent required by law, TempWorks will obtain written authorization from each individual prior to the collection of such data. TempWorks does not sell, lease, or trade any biometric data that it receives from its customers or its customer’s employees or contractors as a result of their use of the TempWorks services.
To the extent that TempWorks’ customers use TempWorks’ Buzz service functionality, timeclocks, or timeclock attachments, they must (1) inform their employee or contract in writing that biometric data is being collected and used, (2) indicate the purpose(s) for collecting biometric data and the length of time for which it is being collected and used, and (3) receive a written release from the employee or contractor authorizing the customer, TempWorks, and TempWorks’ authorized licensors and/or vendors to collect, use, and transmit the employee’s or contractor’s biometric data, and authorizing the customer to provide such data to TempWorks and its authorized licensors and vendors.
TempWorks will not disclose or transmit any of its customer’s employee or contractor biometric data to any person or entity other than the customer and TempWorks’ authorized licensors or vendors, without or unless (1) first having the customers’ employee or contractor’s written consent, (2) the disclosed information completes a financial transaction authorized by the customer’s employee or contractor, (3) disclosure is required by state or federal law, or (4) disclosure is required pursuant to a validly-issued subpoena or warrant.
Biometric data is not stored by TempWorks, and is only briefly utilized for purposes of extracting data points and running them against a unique mathematical equation that attempts to verify the identity of its customers’ employees or contractors, after which time the biometric data is promptly discarded by TempWorks.
TempWorks and/or its vendors shall use a reasonable standard of care to transmit and protect from disclosure any paper or electronic biometric data collected, and shall transmit and protect from disclosure all biometric data in a manner that is the same or more protective than the manner in which TempWorks transmits and protects other personal information that can be used to uniquely identify an individual, or its account or property.
